How Much Is a Truck Accident Case Worth?

Transcript:

How much is my truck accident claim worth? Of course, it will depend on the claim’s own unique circumstances, as it does in every case, whether it’s a truck accident or a car accident. The categories of damages are all the same as with a car accident claim. There’s pain and suffering, and the extent of those damages will again vary depending on, you know, the nature of your pain and suffering and how long you, you know, have lost out on your ordinary enjoyment of life.

Have you lost your amenities of life? The other categories of damages include cost of care, which is exactly what it sounds like, and what your care costs might be today, tomorrow, and into the long term. There’s also a category of damages known as loss of valuable services. That’s a loss in your ability to conduct your housework or your ordinary maintenance of your home. Of course, there’s a category of damages known as loss of income and loss of earning capacity. Your loss of income will, you know, focus on income that’s been lost from the date of the accident up to the present time, the time of the settlement or a judgment in court, whereas your loss of earning capacity is concerned with your ability to earn income into the future if your injuries continue to impact you in such a way that you’re not able to work as you did before suffering your injuries. There’s also a number of other categories of damages: out-of-pocket expenses, subrogation claims.

In the unfortunate event that someone dies as a result of a truck accident, you’d also have the right to bring a claim for wrongful death under what’s called the Fatal Injuries Act, and if that’s the case, the categories of damages are a little bit different than if someone is claiming for all the damages that we’ve previously talked about. So in any event, if and when either of those things happen, it’s always in your best interest to contact a personal injury lawyer.
