Who Is Liable in a Truck Accident?

When a trucking accident happens, people often wonder who is possibly liable. The answer depends on the circumstances of the accident. Now the first line of inquiry is looking at the truck driver him or herself. Just like any driver on the road, truck drivers have to be on the lookout and be cautious for cars around them. If they’re not and an accident happens, then they’re liable. Sometimes it’s the trucking company’s fault, the employer of that truck driver. Perhaps the case that the company has not provided that driver with enough rest.

 

Another possible reason why trucking companies themselves are responsible is if the trucking company failed to inspect or properly maintain the truck, and then, for example, there’s a malfunction that results in an accident. There’s also loading regulations. Trucks have certain weight restrictions or weight capacities that they have to meet. If those aren’t met and an accident happens as a result, then it’s perhaps a loading company that could be responsible for the accident. The final line of inquiry is to look at the truck itself.

 

Was the truck defective such that liability would attach to the manufacturer of the truck? It’s really important, given the severity of injuries that can result from trucking accidents, that lawyers look at all possible avenues towards liability in order to provide full compensation to an injured person.
