What Compensation Can I Receive After a Medical Malpractice Claim?

Compensation for medical malpractice claims is divided into a couple of different categories. The first category is general damages. General damages are just your pain and suffering for the injury itself that was caused by the medical negligence of a doctor or a nurse or any other medical treatment provider. Then a separate category of damages is your income loss, so that injury might have impacted your ability to work insofar as you can’t work at all, or it might impact your ability to work in more nuanced ways, so you might not be able to work to the same extent or at the same capacity.

You can also claim for costs of care, so that would be care and treatment that you might need to rehabilitate yourself after having suffered the injury. You might need some care as it relates to psychological consequences from the malpractice injury. Anything of that nature can be claimed for as part of your damages. And then finally, you can claim for a loss of what’s called valuable or replacement services, that’s services around your home. It’s not necessary that you’re unable to care for your home at all to make that sort of claim. It could just be that you have to do things around the home at a slower pace or that you need some help doing things around the home. That can be compensated for.
