Understanding Negligence and Your Rights in New Brunswick
Negligence arises when a person fails to act as a reasonable person would under the circumstances, causing harm to someone else. Proving the other party’s negligence is critical to a successful personal injury claim.
Examples of negligence resulting in accidents include the following:
- A driver fails to yield the right of way at a stoplight, resulting in a crash that injures another driver.
- A grocery store’s staff doesn’t address or warn customers of a leaky ceiling, leading a patron to slip and fall on an unmarked wet area.
- A doctor fails to check a patient’s medical history before prescribing a particular drug, leading to a preventable allergic reaction.
Often, personal injury victims are found partially negligent in causing their own injuries. Under New Brunswick’s Contributory Negligence Act, you can still recover compensation if you’re partially responsible for an accident. However, your damages will be reduced in proportion to your share of the fault.
When healthcare professionals make mistakes, the consequences can be devastating. If you’ve suffered due to medical negligence, our experienced team is here to help you seek justice.

How Auto Insurance Claims Work in New Brunswick
New Brunswick law requires auto insurance policies to provide the following coverage:
- Third-party liability: Your policy must have a minimum of $200,000 in coverage for bodily injury and property damage you cause in an accident you’re at fault for.
- Direct compensation property damage, or DCPD: This coverage provides compensation for property damage to your vehicle when someone else is at fault for a crash.
- Accident benefits: Known as “Section B” benefits, this no-fault coverage pays for medical expenses and lost income when you’re hurt in a crash.
- Uninsured automobile coverage: This helps cover your expenses if you’re hurt in a crash with an uninsured or hit-and-run driver.
Section B benefits are available regardless of who is at fault for a motor vehicle accident. If you’re pursuing a personal injury claim against another driver’s third-party liability insurance, you can usually receive Section B benefits as well.
Compensation Available in a New Brunswick Personal Injury Claim
You may be entitled to a variety of damages based on how badly you were hurt and how your injuries will impact your life, including:
- Medical bills
- Future treatment expenses
- Lost wages and future earning potential
- Pain and suffering
- Emotional distress
- Special damages
If you were involved in a motor vehicle accident, you may qualify for up to $50,000 of no-fault medical coverage and 80% wage replacement through Section B benefits. Section B can help cover your expenses while you wait for your legal claim to resolve.
What to Do After an Injury in Fredericton
What you do right after an accident can significantly impact the strength of your personal injury claim. Steps to take in the immediate aftermath of an injury accident include the following:
- Document the scene. If you can, take photos of the damage and your injuries and get contact information from witnesses and anyone involved.
- Seek medical attention. Getting immediate treatment is crucial for your recovery. In addition, early evaluation provides evidence linking your injuries to the accident and establishes the severity of your condition.
- Report the accident. Law enforcement will generate a police report that could yield critical evidence for your case. If you have been in a car accident, you may be legally required to call the police.
- Be careful interacting with insurers. Your insurance company may require you to disclose a potential claim quickly after an accident, but don’t say anything more than necessary to avoid undermining your case.
- Speak with a lawyer. You should always consult with a trusted lawyer before agreeing to any settlement offers or communicating extensively with the other party.
Act Promptly
Under the New Brunswick Limitation of Actions Act, you generally have two years from an accident to file a personal injury claim. If you miss the deadline, you’ll lose your chance to recover compensation. So, it’s important to get started on your claim sooner rather than later.
