A birth injury claim is worth pursuing if there’s been a breach of some standard of care performed by a doctor, and if that breach of standard of care has caused some sort of injury to your baby. So typically the causes of birth injuries are lack of oxygen, fetal monitoring issues. So any changes in heart rate, delivery issues, delayed C sections, for example, mechanical issues with forceps or vacuum extractors, things like that can cause birth injury.
What makes those viable is if you believe that because of some issue that occurred, your baby was injured, and if you believe something that was done by the doctor could have been done differently or would have been done differently by a reasonably competent doctor, then that’s definetly something that you should look into. Same applies for any of the nursing staff within the labor and delivery room. If you believe that a nurse or a doctor, in the face of some signs of complications, didn’t operate or treat you in a way that should reasonably be expected, then it would be worth looking into a birth injury malpractice claim.
