If a child has suffered a birth injury, usually it’s an absolutely devastating injury to that child and their parents. It’s the parents who suffer as well. Their lives are turned upside down and oftentimes that injury dictates top to bottom the day-to-day actions of their parents. I’ve seen many parents who’ve had to give up jobs to care for their children, but a birth injury case belongs to the child.
It’s the child who’s been injured through the wrongs of physicians or nurses. And so the claim is brought in the child’s name by a trustee or a litigation guardian and the compensation flows to the child. It’s intended to make the child whole. So at the very least that child’s entitled to pain and suffering compensation.
