BMO Nesbitt Burns Overtime Class Action

Overview

BMO Nesbitt Burns is a large investment firm which employs many Investment Advisors. These Investment Advisors are expected to work long hours by Nesbitt Burns. Valent Legal represents a class of current and former financial advisors employed by BMO Nesbitt Burns over allegations of unpaid overtime in breach of Nova Scotia’s Labour Standards Code.

The class action alleges that by circumventing mandatory overtime rules, BMO Nesbitt Burns has been unjustly enriched to the detriment of the Financial Advisors it employed.

The parties have reached a settlement of this class action. On October 21, 2020, the Supreme Court of Nova Scotia certified the class action. The certification order, along with the Settlement Agreement, can be found here:

Notice Form

The settlement must be approved by a judge of the Supreme Court of Nova Scotia. That settlement approval hearing has been scheduled for March 18, 2021.
